Larry Klayman's litigation against NSA domestic spying on appeal, apparntly remanded on the question of standing, but not dismissed.
Without seeking whether the appellate opinion is online, and without more than scan reading of online reporting, the drift seems to be the appellate court saw the standing question as indeterminate on the interlocutory appeal issues it faced, and remanded to the trial court for discovery to add evidence on the question of standing to sue. Online reporting, here, here and here. The last linked item asserts the appellate court "reversed" the trial court, but it more likely was that the trial decision under review was vacated and remanded.
